1. Scope
This cancellation and withdrawal policy applies to all contracts for courses, coaching sessions, digital content, and other services concluded via the Bcation website. It applies in particular to customers residing in the European Union (EU), especially Germany and Austria, and additionally to customers residing in Switzerland.
2. Right of Withdrawal for Consumers (EU)
If you are a consumer within the meaning of EU consumer protection law, you generally have the right to withdraw from a contract within 14 days without giving any reason. The withdrawal period is 14 days from the date the contract is concluded. To exercise your right of withdrawal, you must inform us of your decision by means of a clear statement, either by email or written letter.
3. Exclusion or Expiry of the Right of Withdrawal
a) Digital Content and Online Services
The right of withdrawal expires prematurely if:
- the contract concerns digital content such as online courses, videos, or downloads, and
- you have explicitly agreed that we may begin providing the service before the withdrawal period expires, and
- you have acknowledged that you lose your right of withdrawal once the service begins.
This consent is obtained during the order or booking process.
b) Lessons and Appointments with a Fixed Date
For lessons, mentoring sessions, or courses with a specific scheduled date, the right of withdrawal expires if:
- the appointment takes place within the 14-day withdrawal period, and
- you have expressly agreed that the service may begin before the withdrawal period expires.
4. Cancellation and Withdrawal (Contractual Terms)
Regardless of the statutory right of withdrawal, the following cancellation conditions apply:
Online Lessons in Groups and 1:1 Appointments
- Cancellation up to 30 days before the scheduled date: free of charge
- Cancellation less than 30 days before the date: 25% of the course price
In-Person Group Courses (not online)
- Cancellation up to 60 days before the course start: free of charge
- Cancellation less than 60 days before the start: no refund, unless there is a valid reason (e.g. illness), at the discretion of Bcation.
5. Compensation for Expenses / Proportional Payment
In the event of a withdrawal or cancellation after the service has already begun, we reserve the right to charge reasonable compensation for work already performed.
This compensation may include, in particular:
- preparation work
- administrative activities
- appointment reservations
The compensation amounts to a maximum of CHF 250. This compensation will only be charged if you have explicitly agreed that the service may begin before the expiry of the statutory withdrawal period.
6. Refunds
In the event of a valid withdrawal, we will refund all payments received without undue delay and no later than 14 daysafter receiving the withdrawal notice. The refund will be made using the same payment method used for the original transaction, unless otherwise agreed.
7. Goodwill Policy
Regardless of the legal regulations, we reserve the right to offer goodwill solutions in justified individual cases. There is no legal entitlement to such goodwill arrangements.
